– Feb 4, 2014, the following email was received: Hi Mr. McDaniel- Thank you for your (Dec 30th) email, below, which was forwarded to me. Please feel free to direct future inquiries to this email address.

The Office of the Assistant Secretary – Indian Affairs is actively working on the Part 83 changes, considering all the comments received on the June 2013 Discussion Draft. Unfortunately, we cannot estimate a date when a rule will be proposed in the Federal Register because there are several intervening steps. One significant intervening step is that the Office of Management and Budget (OMB) has up to 90 days to review the rule once it is signed off by the Department of the Interior. (At that point, you can check OMB’s website at www.reginfo.gov to see that it is under review). Following OMB review, we will publish the proposed rule in the Federal Register for public comment.

 

Please be assured that we are working to get the rule to OMB as soon as possible, and hope to publish a proposed rule soon thereafter this year. Thank you for your interest in this rule.

Feedback: Gentlemen, Please advise on the status of subject, and when updated Part 83 changes are anticipated to be posted in the Federal Register, or released for comment to interested parties. I have requested an update from BIA twice with no reply, and am concerned that subjective and unreasonable wording will not be removed from the updated Part 83 (Native American Tribal Recognition) rules. Subjective and unreasonable Part 83 rules that are being ‘fixed’, need Independent eyes to ensure the updated Part 83 rules are not subjective, are reasonable, and do not require years and tons of money for a very poor and struggling tribe to become recognized. – Two letters were sent to Elizabeth at BIA Nov 26th, & Dec 18th, basically requesting “Please advise when an update status will be available for subject. (Request Update Status for Part 83 Changes)”. If no response is received, will email Kevin (DOI), and will have a sit down meeting with my congressman if no response from Elizabeth or Kevin is received. – Tustinuggee Thlocco

A 4th and final letter was mailed Sept 20th. Sept 27th email from Ms. Appel: “Thank you for the submission of your comments. We will be reviewing them closely.

A letter was mailed Aug 16th. Thanks to those who provided feedback & advice.

– On Aug 13, BIA gave notice the comment date has been extended to Sept 25, 2013.

– On August 6th, an email was sent to consultation@bia.gov: Would appreciate if someone can videotape or audio record each of the consultation group meetings that are starting today, and later post on your website for viewing later. I live in Virginia, and no meetings are being held on the East Coast. Your consideration is greatly appreciated.

reply Aug 6th: Hi Mr. McDaniel – We did not have the sessions taped, but we did have a court reporter and will post all the transcripts of the meetings on our website at: www.bia.gov. Thank you for your interest in this regulation!

– The petition letter was mailed May 15, 2013, to these addressees. The BIA is reviewing changes to the 7 criteria for Tribal Recognition, and will complete their review/changes in June. I hope it makes a difference. Mvto everyone for your support. Update: On afternoon of May 24th, I called BIA and spoke to Lee Fleming’s assistant (in the BIA group that is considering changes to the 7 criteria). He said that they had received my letter, and were in the process of considerations.
